It has been argued that the competition laws and the consumer protection laws were weak and the Australia economy was on the verge of slipping to a comma.[3] There was thus a great need to establish national competition and consumer laws and this lead to the birth of the Restrictive Trade Practices Act 1971[4] and the Trade Practices Act 1974[5] which provided an easy algorithm for resolving market conflicts and challenges.[6] Bradbury contends that the competition law ardently protects the welfare of the consumer and he further notes that since the inception of the Trade Practices Act 1974 there has been incessant pressure to broaden the extent to which the law protect consumers.[7] Small business in Australia were not given sufficient protection by the existing competition and consumer Laws.[8] However, by dint of section 46 of the Trade Practices Act the big established businesses with high market power were enjoined not to take advantage of the small business.[9] The court in Victorian Egg Marketing Board v Parkwood Eggs Pty Ltd[10] remarked that there was a bewildering lack of certainty in the definition of taking advantage in section 46. Conversely, section 51AA buttressed by sections 51AB and 51AC interdicted corporations from the practice of unconscionable conduct in market dealings.[11] It is abundantly clear even that before Trade Practices Act was amended the competition and consumer law protected consumers from unconscionable conduct as is manifested in ACCC v CG Berbatis Holdings Pty Ltd.[12] It bears noting that sections 51AC received a strong dissent from the legal firmament alluding the fact it should have a capacious definition of unconscionable conduct that included unfair and harsh conduct.[13] It is evident that the historical purpose of the competition and consumer laws markedly remains to be preventing the abuse of market power and manipulation that could be perpetrated by corporations for economic expediency. It, however, gives added relevance to note that consumer protection was at the very heart of the cardinal purposes of the historical competition and consumer laws. Changes and Reforms in the Competition and Consumer Law 2010 The principle aim of the Act was to harmonize all the consumer laws that had been entrenched in federal legislations and accord the act the force of a state law.[14] The nerve of the reasoning that informed the reforms was also the acute need to create a system that will be predicated on global best practice. [15] Accordingly, the Act was intended to transform the status quo that had been bequeathed by the state of the market in Australia and the previous law. The changes in the act commenced with the interpretation section where the act introduced new terms and their meaning.[16] The new Act abandoned the old implied conditions and warranties and adopted consumer guarantees. The guarantees explain the rights of the consumers in relation to various products in the market. It is worth noting, however, that the consumer guarantees are guided by the same rules that guide implied conditions and warranties. Even in the face of the reforms and the introduction of the consumer guarantees the case law that was applicable in aiding the interpretation of implied conditions and warranties is still applicable to consumer guarantees.[17] The act has vested in the Australian Competition and Consumer Commission more powers fro enforcement of the competition and consumer laws in Australia. In the old regime that was guided by the Trade Practices Act the ACCC had minimal power and this was manifested by the fact that the commission had no power to initiate cases in its own discretion.[18] However, under the new Act the ACCC may apply to the court for an order to strike out any corporation that it reasonably thinks is contravening the competition and consumer laws. The commission may also apply to the court for an order to solve cases of consumers involving loss or damage. It is instructive to note that a stronger ACCC implies that there will be strict compliance to the competition and consumer laws. One of the most fundamental changes is the introduction of an unfair contract term regime that seeks to declare void any term that is deemed unfair in a contract. The Act suggests that an unfair term is will cause an imbalance between the parties and one party will have an unfair advantage over the other because the contractual obligation are not equal.[19] It is also defined as a term that will have a material detrimental effect on one party to the contract if it was applied to the contract.[20] The court will look at the entire contract objectively before it pronounces that a term in the contract is unfair. The Act also contains new penal provisions such as maximum penalty of $1.1 million will be imposed on corporations and $220,000 on individuals who contravene the provisions of the Previous Act. The Act has given specific provisions from the Trade Practices Act that should not be infringed and hey include unconscionable conduct and misleading and false representations. There has been concerns that the act should introduce criminal penalties that will require a beyond reasonable doubt which is higher than the balance of probability for the civil penalties. Recently the Act has been amended to accord sufficient protection to small business from unfair contract terms.[21] The old provision recognized that it was only the consumers that could be faced with the treat of unfair contract terms. The Act emphatically prohibits the application of any unfair contract terms that will cause the small business to suffer a financial detriment. Conclusion It is a plausible conclusion that the act will promote the steadfast and impartial application of the consumer and competition law. The act should not be viewed as an appendage to the aim of achieving economic injustice but rather it should be regarded as a bastion fro the protection of the consumer rights and the promotion of market fairness and business efficacy. This view is supported by Stuart who highlights the exploitation of black women by black men. However I do not agree with this view. Through the threat from Alphonso, Celie may feel he has power not only over her but also over her loved ones as her mothers life is at risk, as shown by O Connor speaking would be an act of murder, a matricide. By giving Celie the right to write to god he had given her a way out and saved her from becoming insane or mentally ill. Although she cannot tell another person, she has someone to confide in and to share her problems with. The threat from Alphonso supports Stuarts perception that men are mostly troublesome, sometimes cruel. Alphonso here has shown a psychological strength because by threatening her, hes forced her into not speaking to other people about any of her problems and teaching her to keep all her problems to herself. However he is not aware that Celie writing to god allows her to offload and share her problems with someone other than herself. O Connor says that Celies existence to be denied this explains that in her rape experience and also in the fact that she has a lack of voice she is therefore not able to share her bad experience with anyone. However I think she is able to express her feelings through writing so is therefore giving herself a voice and existence which goes against what O Connor states. Walker shows Alphonsos psychological power over Celie in the beginning of her writing letters. Celie crossed out I am. This is almost as if she is crossing herself out. She changes it to, I have always been a good girl. It seems that Celie is taking the blame for what Alphonso has done to her. This is the first time we see an authority figure abuse Celie which reinforces male dominance in her life. The rape not only shows physical power strength and power but also emotional authority, due to Celies naivety, for his own pleasure. Another time in the novel in which we see Alphonsos power over Celie is when he is trying to get rid of her by marrying her off. However its more like he is selling her as they barter, he even throws in a cow. This again relates back and shows how black females in this time period were still being treated as slaves. O Connor tells us her feminist analysis is interested in the voices, as its a male dominated conversation where Celie only gets in a few words on a highly important decision which can affect her whole life. Here Alphonso shows his total power over Celie and the fact that not only does he control her life now, but he also controls her future and how or who she will spend it with. The fact that she cannot decide herself who she wants to marry takes all control away from her. Throughout this Celies voice is absent, and even when its important decisions about her own life she still seems to have no voice. Religion to the lives of the people in the novel was not the sanctuary it might have been according to Mary OConner, Alphonso gave Celie one way out perhaps the result of some dialogical residue of his Christian culture. However Celie received a beating after church, cause he say I winked at a boy in church. The colour purple itself is a symbol of violence which runs throughout the novel as its the colour of bruises. However it can also portray authority as its the colour of royalty. Walker symbolises power through this quote, womanism is to feminism as purple is to lavender. This tells us Walker thinks womanism as a stronger form or feminism as the colour purple is brighter than lavender. Shug tells us that the colour purple is everywhere and that God has used this colour to portray beauty, I think it pisses God off if you walk pass the colour purple in a field somewhere and dont notice it. It can also be said that Gods love for this colour made black people in this complexion as in one of Netties first letters to Celie when she arrives in Africa she talks about the Senegalese peoples skin, So and so is blacker than black, hes blueblack. Another section of power in the novel is the physical domination of the women. Celie being a black woman is disadvantaged as not only is she looked upon as a slave but she is also dominated by the male authorities in the novel. She suffers at the hands of men. We can therefore argue that the emancipation proclamation of the post civil war era freed men but not the women because the male authority then saw the woman as their slave which is how Celie is treated by both Albert and Alphonso, we see this when Albert does not get off his horse to meet Celie but also speaks about her in third person, Hes still on his horse. Access to the law and legal system is the ability to shape it, both in its meaning and understanding. While the factors that usually determine the power to shape law are not static, in general, access to law has been held by specific groups of people: the wealthy, males, whites, and religious authorities. In constructing the law, these specific groups have traditionally used their power to reinforce their dominant position and impede the ability of powerless groups to further their interests. It is this position of advantage that allows the prevailing groups to maintain a system of inequality fortified by the law that protects their prosperity while forcing the disadvantaged to appeal to problematic methods to promote their well-being as a result of their lack of access. In his speech, â€Å"Address to the Prisoners in Cook County Jail,† Clarence Darrow defines law as a creation of the rich, who, because of their wealth, own and control most of the property and institutions of society (Darrow 229). The access that comes with their wealth then grants them the power to construct the law in a way that sustains their elite position. For Darrow, as a consequence of this system of power, the unprivileged individuals are forced to seek out other, often criminal means of living in order to survive. He explains this by stating, â€Å"The more that is taken from the poor by the rich, who have the chance to take it, the more poor people there are who are compelled to resort to these means for a livelihood† (227). LPN Scope of Practice Essay

The Nurse is defined by the University of North Carolina as â€Å"the leader in providing compassionate, quality care, focusing on the unique needs of patients and their families.† It goes on to define the Nurse as someone who â€Å"collaborates with patients families and other health team members to plan and provide Nursing care that will achieve an optimal level of health and wellness, or when this is not possible, support the experience of loss and death.† I completely agree with these statements. Deciding to take on the role of a Nurse shows the selflessness of the person. It is making the decision to put someone else before one’s self. It is the act of transforming from whatever type of person they are on the outside of the work place, and becoming someone who is non-judgmental, optimistic, positive, caring, empathetic and has the understanding ability to be able to provide care while respecting the patient’s wishes and beliefs. I feel as if certain c haracteristics of the Nurse are not taught. These are personality traits that we are born with and whether or not we utilize them, is up to us. Other Characteristics of the Nursing role, I feel are obtained by training and education. For example, inserting a Foley catheter, or any sterile procedure for this matter, training has to take place for the Nurse to properly insert the catheter. We have to be trained how to properly open the package, how to move so that sterility isn’t broken and know proper techniques to insert the catheter. The Nurse must be trained on how to do this skill but unless she is educated, then the skill is useless. The Nurse is educate on rationales to each step, i.e.: Why am I doing this?, What am I  looking for? What do I do If this happens? How will this affect the patient? Nursing is an incredibly interesting field with many doors of opportunity. It is a field that interests me greatly. There are so many different areas of nursing which makes the learning process never ending. While pursuing my Nursing license, I find it extremely comforting to know that if I ever feel â€Å"burnt out† on a specific area of the field, I can move on to different areas. I am not obligated to do the same type of Nursing for the rest of my life. My options are endless. While comparing the roles of the Licensed Practical Nurse in North Carolina versus South Carolina, I was a little surprised at some of the differences. I had a very hard time finding specific skills that an LPN in NC could perform. We are directed straight other pages which don’t necessarily directly state do’s and don’ts. Some skills with both North Carolina and South Carolina can be performed by the LPN if, and only if, the employer has documentation of proper training, continuing educations courses, verification of skill competency by at least an RN, and frequent evaluation of the Nurse’s competency of completion with the skill being performed, on file. Both states have set rules on how much continuing education is necessary or how frequent the skill competencies should be evaluated. Both States allow the Licensed Practical Nurse to assist in preforming the initial assessment but are not allowed to make nursing diagnoses. They both allow the LPN to verify blood with an RN but LPNs are not allowed to hang blood. Neither state allow the LPN’s to do any pulmonary artery pressure or pronounce death. Also, in South Carolina the Licensed Practical Nurse cannot evaluate or stage p ressure ulcers, they can only document on the observations of the ulcer once the RN have evaluated and staged it. In North Carolina, the LPN can first assess and size the wound or ulcer or even change the dressing under a specific order and a Registered Nurse will verify the LPN’s evaluation. South Carolina does not allow LPNs to do any arterial punctures, but they can manage the site; LPN’s in North Carolina can complete arterial punctures for the collection of blood. The two differences that fascinated me the most dealt with acupuncture and cosmetic procedures. In North Carolina, the LPN, or the RN, cannot practice acupuncture. It is prohibited, unless an individual has completed a 3 year postgraduate acupuncture college or training program verified by the state. In South Carolina, an LPN can practice acupuncture  under a Licensed Acupuncturist as long as he/she has been trained under the employer, it is documented, and a request to practice has been approved by the state. With cosmetic procedures, in South Carolina a Licensed Practical Nurse can only apply chemical peels with less than twenty percent acid solutions and they may also do a microdermabrasion under a dermatologist. In North Carolina, a Licensed Practical Nurse can do a broad range of skills in the cosmetology field. He/She may give a microdermabrasion, chemical peels, give Botox, collagen injections and laser hair removal. With Botox and Collagen injections affecting the appearance so greatly, it is hard to believe that this is a skill that an LPN can become properly trained on. The Charge Nurse role is defined by the North Carolina Board of Nursing as â€Å"an RN who supervises and manages patient care delivery settings or groups of clients, usually for designated time periods.† It also defines the Nurse-In-Charge role as â€Å"the assigned role and responsibility of an LPN who participates in assuming the implementation of established health care plans for a designated number of clients under RN supervision.† Basically how I interpreted this was, the LPN can be the Manager when the Manager is away. The Licensed Practical Nurse will continue to work in the appropriate scope of practice and report to the Registered Nurse. The LPN will call to report updates or for guidance in certain situations. If the task at hand is not in the scope of practice for the LPN, the RN will be called to come in to make decisions or perform the tasks. Working in a long term care facility has helped me better understand the difference between the two, although we do not use the term Nurse-In-Charge as often as we should. On weekends we have two specific Nurses who work opposite weekends of each other and are delegated the responsibility of being the Nurse-In-Charge. On Fridays, before our Charge Nurse leaves for the weekend, she will do a quick run through with the Nurse-In-Charge for the weekend. They go through and talk about the â€Å"what if’s?† for the weekend, and what to do and not to do. These Nurses also know when a phone call needs to be placed to the Charge Nurse. Throughout the weekend, they call with updates and notify the Charge Nurse of any changes that have or are occurring with any health statuses of the Residents. Depending on the situation, the RN delegates appropriate tasks in the LPN’s scope of practice over the phone or, if another RN is not in the building, she will come into work if needed. It is said that we,  ourselves, are our biggest critics. For me this is extremely true, so when it came to trying to determine my strengths, it took a while. Based on what others have told me, I’ve got an abundance of patience and I also have good communication skills. I’ve always had strong relationships with my residents and their family members. When trying to decide what my strengths were, I had to ask myself â€Å"Why do the y like me?†, â€Å"Why do they treat me as if I’m a part of their family?† â€Å"Why do they trust me?†. What came to mind was the way I talk to them. I speak to residents and families the way I would hope to be spoken to, if the roles were reversed. I believe that good communication skills, including the ability to listen, would be something positive I could bring to the role of the LPN. I hope to be an influence to other Nurses who come in with bad attitudes and forget that their patients are humans too. To remember that even though they may be a â€Å"frequent flyer†, they are still human, they still make mistakes, and more than likely are in desperate need of kind words. I hope to influence others when it comes to being open minded and influence them when they go to pass judgment. I hope to bring more compassion, optimism, acceptance and leadership to the LPN Role. My weaknesses are my confidence in my decisions and my abilities. I second guess myself a lot and I constantly double check myself. This could work both ways, good and bad. I look for reassurance from others to ensure that I am right and I know that I won’t always be in a position where I can be reassured. I want to gain the confidence without becoming â€Å"the know it all.† A good quality Nurse is one who’s always willing to learn. Another weakness I have is my inability to handle the emotions of the family members during the harder times. Times like these are very awkward for me and I would like to get stronger in my ability to be comforting and supportive. I usually try to avoid these situations as much as possible because the wall that holds my emotions in during these times, is very thin.
